CONNECT TERMS OF USE

This Connect Terms of Use is an agreement between you (“You”) and The New York and Presbyterian Hospital, Cornell University for Weill Cornell Medicine and/or The Trustees of Columbia University in the City of New York for Columbia University Irving Medical Center (collectively the “Institution”). TO USE CONNECT, YOU MUST ACCEPT THE TERMS AND CONDITIONS SET FORTH IN THIS TERMS OF USE AND AGREE TO BE BOUND BY THE INSTITUTION’S NOTICE OF PRIVACY PRACTICES WHICH IS HEREBY INCORPORATED INTO THESE TERMS OF USE BY CLICKING "I ACCEPT" BELOW. IF YOU DO NOT AGREE TO THE TERMS OF USE, YOU WILL NOT BE ABLE TO USE CONNECT. The Institution participates in an Organized Health Care Arrangement (OHCA) among The New York and Presbyterian Hospital, Cornell University for Weill Cornell Medicine, The Trustees of Columbia University in the City of New York for Columbia University Irving Medical Center and their related entities. This allows these institutions to share health information to carry out treatment, payment and joint health care operations relating to the OHCA, including sharing billing information, insurance information and information to improve the quality of the services we provide You and other patients of the Institution.

USE OF PROTECTED HEALTH INFORMATION

When you use Connect to store or retrieve personal and medical information, all of the data is stored in your personal account. All personal and medical information you enter into Connect is governed by these terms and conditions and any other contained or referenced in this Connect site, including the Institution’s Notice of Privacy Practices which can be found here. When you provide personal and medical information through Connect, you authorize the Institution to use and distribute it in connection with Connect and in accordance with the Notice of Privacy Practices.

As part of Connect, you may authorize your participating providers to provide personal information about you. You may use Connect to share certain personal information with such providers. You may use Connect to communicate with such providers. You understand that any decision to use Connect in such ways is entirely voluntary. You understand that if you authorize a provider to access your personal information in Connect and communicate with you via Connect that provider may permit its/his/her staff and other authorized users within its/his/her facility or office to use Connect to access your personal information and communicate with you as well.

The Institution may enable you to integrate your Connect record with other personal health records of yours that are held by your other healthcare providers outside of the Institution. In order to use a specific available service, you must inform the Institution that you would like to allow another healthcare provider to retrieve, provide, and/or modify information in your Connect account. Once you authorize a specific provider to access your Connect account, such provider may continue to access your account until you affirmatively disable access. Your provider may include your doctors, their medical staffs and other entities working on behalf of your doctors and medical staffs.

You may also enable a provider to have access to your Connect record on a one-time, temporary basis through “Share Everywhere” available at https://shareeverywhere.epic.com; such access requires the provider be given a “share code” generated by you in Connect. You are solely responsible for reviewing and approving each provider or other party requesting access before sharing your information through Connect or otherwise allowing them to access it. If you elect to use any service the Institution adds to or enables within Connect, such election constitutes your authorization and consent to sharing your personal information with all authorized third-parties.

CONTENT USAGE

The Institution uses this website (Connect) as well as their other websites and branded social media sites to provide general information about health care topics. The contents of these sites, such as text, videos, graphics, images, quoted information and all other materials (“Content”) are provided for reference only and may not be complete, up to date or exhaustive or applicable to any particular individual’s medical condition. Content is not medical advice and is not to be used or relied on for diagnosis or treatment. Content is for informational purposes only and does not take the place of diagnosis, instructions or advice from your doctor or health care providers and may not necessarily take into account your individual health situation. Talk to your doctor or other health care providers before making a health care decision. Reliance on any Content is solely at your risk. Users are warned to follow the advice of their physicians without delay regardless of anything read in this Health Library. The Institution assumes no duty to correct or update the Content nor to resolve or clarify any inconsistent information which may be a part of the Content. When using Connect, you may sometimes be offered links to third party websites not managed by the Institution. The Institution is not responsible for and has not verified the information or materials contained on any third party web sites, or on web sites that provide links to Connect and You should not rely on any of the information found on these websites for purposes of diagnosis or treatment. Links from Connect are provided for informational purposes and for your convenience only and are not intended as an endorsement by the Institution of the organization or individual operating the third party website or application or a warranty of any type regarding either the third party website or application, or the information on the third party web site or application. The Institution shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, products or services available on or through such third party websites or applications.

ELIGIBILITY AND PROXY ACCESS

Any adult age 18 or over is eligible for a Connect account. Parents or guardians of minor children newborn to day before 12th birthday inclusive, may request proxy access to their child's account by following the terms below. Minor children between the ages of 12 and 18th birthday inclusive will be eligible to participate in Connect. Children in this age range will have the same access as adult eligibility.

Adult patients may grant proxy access to their Connect account to other adults age 18 and over, by completing a Proxy Access Consent Form. This Adult to Adult Proxy access does not expire, and shall remain active until the proxy access is revoked by either the adult patient from within their Connect account, or by the patient notifying the Institution and requesting the proxy access be revoked. The Institution reserves the right to revoke proxy access at any time for any reason, unless otherwise required by law.

Parents or guardians of minor children, newborn to day before 12th birthday inclusive, may request proxy access to the child's Connect account. Such access will only be granted to parties with parental rights or legal guardianship over the Connect account holder. A Connect account will be activated for both the proxy and the child patient. The proxy will access the child's health information through the proxy account. If the proxy's legal relationship with the account holder changes, the proxy must inform the Institution immediately by contacting the provider. Due to limitations currently imposed by State and Federal law, when a minor patient reaches age 12, their Connect account shall be deactivated, along with all proxy access to the account and access to the account must be created by the minor.

Parents or guardians of children age 12 to 18th birthday inclusive may only be granted proxy access to the child's Connect account by the child signing a Proxy Access Consent Form. Proxy access consent will need to be renewed every two years. Proxy access will be restricted to comply with the limitations currently imposed by State and Federal law. Proxy access will be terminated when the child reaches 18 years of age.

The Institution reserves the right to revoke proxy access at any time for any reason.

MEDICAL DISCLAIMER

Communications with healthcare providers through Connect are not in "real-time", and should not be used for urgent or emergency situations. The Institution will make its best effort to provide a timely response to electronic inquiries. In some cases, the clinical staff that needs to respond to an electronic inquiry or other communication may not be immediately available so a patient should allow at least two (2) business days for a response. Accordingly, situations requiring immediate attention should not be submitted electronically through Connect. Furthermore, with respect to any electronic communications sent by the patient, the Institution is only able to respond to such communications based on the information provided by the patient. If there is insufficient information provided, the Institution will be unable to provide an accurate and reliable response. Response time of Connect may be longer than normal if service is interrupted for maintenance, upgrades, or emergency repairs related to events beyond Institution’s control. You agree not to hold the Institution, its affiliated practices, providers or any of its staff, in any way liable or responsible to you for such modification, suspension or disruption of Connect.

Connect does not provide any medical services, including emergency or urgent medical services. PLEASE CALL 911 OR YOUR HEALTH CARE PROVIDER IF YOU BELIEVE THAT YOU ARE EXPERIENCING A MEDICAL EMERGENCY OR IF YOU NEED URGENT CARE.

The Institution is not responsible for the accuracy, timeliness, completeness or Your or any medical professional’s reliance on Your personal information contained in or accessed through Connect unless such information is posted by the Institution, contained in your medical record, or imported by you and validated by your doctor or other health care provider.

DISCLAIMER OF WARRANTY

THE INSTITUTION PROVIDES CONNECT "AS IS" WITH ALL FAULTS AND MAKE NO WARRANTIES OR GUARANTEES OF ANY KIND, AND EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF ANY KIND OR NATURE, WHETHER EXPRESS, IMPLIED, OR STATUTORY REGARDING CONNECT, INCLUDING BUT NOT LIMITED TO THE ACCURACY, COMPLETENESS, CORRECTNESS, AVAILABILITY, SECURITY, TIMELINESS OR USEFULNESS OF ANY INFORMATION, PROGRAMS, PRODUCTS, OR SERVICES, OR OTHER MATERIAL PROVIDED THROUGH CONNECT, OR OF RELIABILITY, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

LIMITATION OF LIABILITY

IN NO EVENT WILL THE INSTITUTON OR ITS AFFILIATES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, SPONSORS AND AGENTS BE LIABLE TO YOU, ANYONE CLAIMING BY THROUGH OR UNDER YOU, OR ANYONE ELSE FOR (i) ANY DECISION OR ACTION TAKEN, OR NOT TAKEN, IN RELIANCE UPON THE INFORMATION CONTAINED OR PROVIDED THROUGH CONNECT, (ii) CLAIMS ARISING OUT OF OR RELATED TO CONNECT, (iii) YOUR OR THIRD PARTY USE OF CONNECT, (iv) YOUR USE OR DISCLOSURE OF YOUR PERSONAL OR MEDICAL INFORMATION THROUGH YOUR USE OF CONNECT OR (v) FOR ANY DAMAGES OF ANY KIND UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH USE OF, OR INABILITY TO USE, CONNECT, INCLUDING ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, WRONGFUL DEATH, DAMAGES RESULTING FROM DELAY, INTERRUPTION IN SERVICE, VIRUSES, DELETION OF FILES OR ELECTRONIC COMMUNICATIONS, OR ERRORS, OMISSIONS OR OTHER INACCURACIES IN SERVICE, POSSIBLE HEALTH SIDE EFFECTS, OR FINANCIAL LOSS, EVEN IF THE INSTITUTION KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES, CLAIMS, DEMANDS OR ACTIONS. THE INSTITUTION SHALL NOT BE HELD LIABLE UNDER THIS AGREEMENT FOR MORE THAN $1,000. IF ANY PROVISION IN THIS LIMITATION OF LIABILITY SECTION IS NOT PERMITTED BY GOVERNING LAW, SUCH PROVISION SHALL NOT BE CONSTRUED TO BE NULL AND OF NO EFFECT, BUT SHALL BE CONSTRUED TO PROVIDE FOR THE MAXIMUM ENFORCEABLE APPLICATION.

TERMINATION

The Institution may place limits on, modify, suspend or terminate all or any portion of Connect at any time without prior notice. Additionally, notwithstanding the rights you may have to the personal information and/or data in your Connect record, if any, the Institution may cancel your account and delete all data associated with your account at any time, and without notice, for any reason. The connection to your provider may be modified, suspended, or terminated by your provider at any time and without notice, however, you will still have access to your Connect account. In addition, except with respect to a proxy who establishes an account on behalf of a minor child or other individual as described herein, the Institution will terminate your account following notification of your death. Accordingly, you are solely responsible for maintaining your own copies of any data or personal information maintained within Connect or of any communications received through Connect. The Institution assumes no liability for any information removed from Connect. The Institution also has the right to maintain and/or destroy all data associated with your account in accordance with its then current document retention and destruction policies. Upon any termination of your access to Connect, you must cease all use of Connect.

GOVERNING LAW

Connect may only be accessed from the United States of America.

This Agreement, and any claim, controversy or dispute arising under or related to this Agreement, the relationship of the parties and/or the interpretation and enforcement of their respective rights and obligations, shall be governed by and construed in accordance with the laws of the State of New York, without regard to principles of conflicts of law. The parties hereto agree to the exclusive jurisdiction of the courts located in the State of New York and the exclusive venue of New York County.

These Terms of Use may be amended by the Institution at any time without notice by posting the amended Terms of Use to the Connect web site and providing a notice on the website that the Terms of Use has changed. Upon Your next use of Connect, you will be asked to accept these changes by clicking “I Accept” which shall be deemed acceptance of the new Terms of Use. If you do not so agree to the Terms of Use as amended, you shall stop using Connect and the Institution shall cancel your account. You agree that this User Agreement sets forth the entire understanding between you and the Institution. You further agree that if any portion of this User Agreement is held invalid, the balance shall continue in full force and effect.
